These Terms of Service (“Terms”) govern your use of the VIBE - AI Video Generator mobile application (the “App”) and the website at https://www.create-aivideo.com (the “Website”), operated by Rocket Digital Limited (“we,” “us,” or “our”). By using the App or Website, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, or by accessing the Website, you agree to these Terms. If you do not agree, do not use our services. We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance of the updated Terms.

2. Description of Service

VIBE is an AI video generator application that allows users to create video content from text prompts and images using various artificial intelligence models. The App is available on iOS (Apple App Store) and Android (Google Play Store). The service utilizes third-party AI models and cloud computing infrastructure to generate video content.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account and use the App.

4. Subscriptions and Payments

The App offers both free and premium subscription tiers. Premium subscriptions are processed through the Apple App Store and Google Play Store, managed via RevenueCat.

  • Free Tier: Limited daily AI video generations with standard quality.
  • Premium/Pro Tier: Unlimited generations, higher resolutions, priority rendering, and commercial usage rights.

Subscription billing, cancellation, and refund policies are governed by the respective app store's terms (Apple App Store or Google Play Store). Prices may vary by region and are subject to change.

5. User Content and AI-Generated Content

5.1 Your Input Content

You retain ownership of any text prompts, images, or other content you submit to the App (“Input Content”). By submitting Input Content, you grant us a limited, non-exclusive license to process it through our AI service providers solely for the purpose of generating your requested video content.

5.2 AI-Generated Content

Subject to these Terms and your subscription plan, you are granted a license to use AI-generated video content created through the App. Pro subscribers receive commercial usage rights for their generated content. Free tier users may use generated content for personal, non-commercial purposes.

5.3 Content Restrictions

You agree not to use the App to generate content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of third parties
  • Contains or promotes sexually explicit material involving minors
  • Promotes violence, discrimination, or hate speech
  • Is designed to deceive or mislead (deepfakes for fraud)
  • Violates any applicable laws or regulations

We reserve the right to refuse service, remove content, or terminate accounts that violate these restrictions.

6. Intellectual Property

The App, Website, and all associated intellectual property (including but not limited to software, design, text, graphics, logos, and trademarks) are owned by Rocket Digital Limited and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our express written permission.

7. Third-Party Services

The App integrates with various third-party services for AI processing, authentication, analytics, and advertising. These include but are not limited to:

  • Firebase (authentication, database, analytics)
  • RevenueCat (subscription management)
  • Google AdMob (advertising)
  • OpenAI, Microsoft Azure, Replicate, Fal.ai (AI processing)
  • Google Analytics, Meta Pixel (website analytics)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

8. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated content may contain inaccuracies, artifacts, or unexpected results. We do not guarantee the quality, accuracy, or suitability of any AI-generated content for any particular purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR WEBSITE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App or Website, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
